for using Rubicon Ltd. services

These general terms and conditions apply to all traffic visiting this website, so before continuing on, read them carefully please.

Glossary

Article 1. The terms used in the 'General terms and conditions' have the following meanings:

Customer is anybody, regardless registered or not with IMOTBG.NET, using Rubicon Ltd. services which are part of these 'General terms and conditions.'

Website is a particular Internet area accessible through its Uniform Resource Locator (URL) and containing files, programs, texts, sounds, pictures, images, or other materials and resources.

Article 2. Rubicon Ltd. provides at IMOTBG.NET some services which can be used by the customers only if the customers meet the requirements described in the General Terms and Conditions.

Description of the Services

Article 3. Rubicon Ltd. provides the following services:

database with real estate offers, possibility to upload real estate offers, news, e-mail notifications, advertisements, links to other web pages and some other services connected with the real estate. All updates posted on the website are governed by the General Terms, unless otherwise specified.

Acceptance of the General Terms and Conditions

Article 4. Clicking the hyperlink in IMOTBG.NET, the customer declares that he/she agrees with the 'General Terms and Conditions' and he/she is bound to follow them. 'General Terms and Conditions' are displayed prominently in 'IMOTBG.NET'

Changing of the 'General Terms and Conditions'

Article 5. 'General Terms and Conditions' are subject to change at any time by Rubicon Ltd. Rubicon Ltd. is obliged to inform the customers about the changes.

Registering in 'IMOTBG.NET'

Article 6. After registering in 'IMOTBG.NET', customers get unlimited access to Rubicon Ltd. services. Registering, customers have to give the complete necessary data regarding their identity (natural person) or legal statute (judicial person); and whenever these are changed, they should be updated in due time. In case the customer uses incorrect personal details, Rubicon Ltd. has the right to terminate its services without any previous notice.

Customer's Rights and Obligations

Article 7. The customer has the right to use the website services for free.

Article 8. Using the services offered by Rubicon Ltd, the customer is obliged not to upload or reveal to third parties information, data, text, pictures, etc. which:

are in conflict with the Bulgarian laws and regulations, the applicable foreign laws, and these General Terms and Conditions;

undermine the authority of third parties and instigate to a forcible change of the regulations laid down by the Constitution, as well as instigate to commitment of crimes, violence or stirring up of racial, national, ethnic, religious hatred; preach fascist or any other antidemocratic ideology;

harm somebody's rights and interests, such as title, copy-right, etc.;

have pornography or other types of immoral content;

advertise unless previously agreed with Rubicon Ltd.;

contain trade or business classified information;

represent themselves as another natural or judicial person whom they haven't been authorized to be representing;

If the requirements above are not met, Rubicon Ltd has the right to delete from its website the corresponding information or items.

Article 9. The customer is bound not to undertake any actions which might cause harm to third parties with internet connection i.e. getting access to resources with rights and passwords of other people, damaging info systems, sending spam, taking advantage of the systems in order to derive personal benefits or to get information, sending of 'Trojan horses' or being at the bottom of viruses, disturbing the work of the other users, undertaking actions which may be qualified as crime or infringement of the Bulgarian laws.

Exclusion of warranties

Article 10. The information, software, products and services of IMOTBG.NET may have some inaccuracy or print errors.

Article 11. Rubicon Ltd. excludes all liability whatsoever for the way customers use the services provided by this website; the company is not obliged to record the information processed in 'IMOTBG.NET' by the customer, as well as the information which the customer has made known to third parties. In this respect Rubicon Ltd. assumes no responsibility for the customer's deeds.

Article 12. Rubicon Ltd. reserves the right at any time, without notifying the customer, to delete or limit the access of some user names and passwords which do not agree with the above mentioned 'Terms and Conditions.' Rubicon Ltd. is not liable towards the customers for any damage caused and missed benefits.

Article 13. Rubicon Ltd provides hyper-links from 'IMOTBG.NET' to other websites and resources. These websites and resources are beyond the control of Rubicon Ltd., as a result of this Rubicon Ltd. cannot be held responsible for any damage caused and missed benefits related to the accuracy, relevancy, legality or copyright compliance of this material and content on such third party websites. The customer assumes full responsibility for all damage caused to Rubicon Ltd. and third parties as a result of using or accessing these websites and resources.

Article 14. Customer is bound to recoup Rubicon Ltd. for damages and missed benefits, including all expenses which are the result of claims by and /or cost to third parties related to websites, hyper-links, material or information which the customer has used, sent, included into 'IMOTBG.NET' or the customer has given access to third parties as an offence against the law or these General Terms and Conditions.

Collecting and Using the Information

Article 15. Rubicon Ltd. has the right to collect and use information about its customers. The information could be used for offering new services to the customers, as well as for statistics unless otherwise specified by the customer to the following e-mail address: rubikon@mail.bg

Disclosing Information

Article 16. Rubicon Ltd. is not going to disclose the information to third parties - government authorities, trade companies, natural persons and others unless:

Rubicon Ltd. has the explicit consent of the customer;

The information shared is related to required services, orders or deliveries;

Customer is violating the General Terms and Conditions with their action;

There are legal proceedings or arbitrage claims against the customer for third party's damages related to the use of Rubicon Ltd. services;

Rubicon Ltd. has to disclose information in all cases specified in the legislation.

All content and design of 'IMOTBG.NET', as well as the very name, is protected by copyright, trademarks and other intellectual property rights and is the property of Rubicon Ltd.

The information needed for identifying the customer in case of a legal dispute is kept by Rubicon Ltd. in the log-files of 'IMOT.BG' server.
